Legal notice for seeds

Cannabis seeds are not controlled by the 1961 Single Convention on Narcotic Drugs, signed in New York on March 30, 1961, amended by the Geneva Protocol of March 25, 1972 and ratified by the Spanish State.

The Single Convention establishes which part or parts of the Cannabis sativa L. plant are controlled: the flowering or fruiting tops of the cannabis plant, as well as the resin obtained from the cannabis plant, but expressly excludes the seeds. Seeds are excluded from the legal definition of cannabis and are not included in its Annexed Schedules.

The seeds of the Cannabis Sativa L. plant lack the active ingredient Delta-9 tetrahydrocannabinol (THC).

Therefore, according to the Single Convention, cannabis plant seeds are not controlled and cannot be classified as narcotics.

Growing cannabis for personal use may constitute an administrative offense in accordance with Article 36.18 of Organic Law 4/2015, of March 30, on the protection of public safety, if it is done in places visible to the public.

BK Seeds are not commercial varieties and are not intended for agricultural cultivation. The seeds are sold for personal use by individuals over 18 years of age only. BK Seeds markets cannabis seeds as items intended for collecting or genetic preservation, with the specific restriction that they may not be used for purposes that violate current regulations.

In accordance with the principle of mutual recognition, Member States of the European Union cannot prohibit the sale in their territory of goods that are lawfully marketed in another Member State, even when those goods have been produced in accordance with different technical standards (Regulation (EU) 2019/515 of 19 March 2019 on the mutual recognition of goods lawfully marketed in another Member State).

National laws regarding cannabis seeds vary considerably from country to country. In some, germinating and cultivating cannabis for personal use, and even simply possessing the seeds, can constitute a criminal offense. BK Seeds does not intend to encourage anyone to break the law in any country.

For this reason, we ask non-resident buyers to familiarize themselves with applicable local legislation. BK Seeds encourages its customers to act responsibly.
